Privacy policy


1. These rules for personal data protection (hereinafter only the “Rules”) stipulate the rules for the processing of the Buyers’ personal data during the sale and purchase of the goods and services and related activities (hereinafter only the “Buyer”) offered by the business company 100MEGA Distribution s.r.o., Company ID No.: 60707968, with its registered office: Železná 681/7, Horní Heršpice, 619 00 Brno, entered under File No. C 15317 in the Commercial Register maintained by the Regional Court in Brno (hereinafter only the “Seller”) on the website b2b.100mega.cz and stipulate the rights and obligations of the Parties.


2. The Seller is the Controller of the Buyers’ personal data pursuant to Art. 4, Point 7 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, as amended (hereinafter only the “GDPR”). The Seller processes, in compliance with legal regulations, namely the GDPR, the personal data of:  a) the Buyers who registered themselves and those registered Buyers who entered into a contract of sale with the Seller, b) visitors of the Seller´s website.


3. Upon registration and entering into a contract of sale, personal data are required for the successful performance of the purchase order (in the scope of name, surname, address/registered office, telephone number, e-mail address, Company ID No., Taxpayer ID No.). The purpose of the personal data processing is registration for the performance of a contractual relationship, performance of purchase orders, exercising of rights and obligations arising from the contractual relationship, addressing of complaints, recovery of receivables, verification and assessment of payment history via registers of debtors, and the company’s own marketing and business purposes, including direct marketing (sending of commercial messages, gifts).


4. The legal grounds (title) for the personal data processing is the performance of a contract pursuant to Art. 6 (1), Letter b), GDPR, and the legitimate interest of the Seller pursuant to Art. 6 (1), Letter f), GDPR.  The legitimate interest of the Seller is the processing of the personal data for the purposes of direct marketing (sending of commercial messages), sending gifts to Buyers based on the rules relating to the contractual relationship, and the verification and assessment of payment history via registers of debtors. The Buyer may file an objection against the processing of personal data for the purposes of direct marketing in the scope of name, surname, e-mail address, and tel. no. pursuant to Art. 21, GDPR, by writing to the e-mail address info@100mega.cz. In such a case, the Seller will not process these data any longer unless the Seller evidences material justified grounds for the processing prevailing the interest or rights and freedoms of the data subject or for the determination, exercising or defence of legal rights.


5. The Seller uses the services of sub-suppliers to fulfil the legitimate interest, mainly mailing services providers (personal data kept in the EU) and hosting services providers. The sub-suppliers have been checked for safe personal data processing. The Seller and the sub-suppliers have entered into an agreement on personal data processing according to which the sub-suppliers are responsible for the proper security of the physical, hardware and software perimeter and therefore the Seller is directly liable to the Buyer for any leak or breach concerning the personal data.


6. The Seller shall keep the personal data of the Buyer for the time necessary to perform the rights and obligations arising from the contractual relationship and exercising the claims based on these contractual relationships (for the period of 15 years from the termination of the contractual relationship). After its elapse, the data shall be deleted. The Seller shall keep the personal data of website visitors until they withdraw their consent.  


7. The Buyer shall have the right to request from the Seller access to the Buyer’s personal data pursuant to Art. 15, GDPR, the correction of personal data pursuant to Art. 16, GDPR, and the possibility to restrict the processing pursuant to Art. 18, GDPR. The Buyer shall have the right to the deletion of personal data pursuant to Article 17(1), Letters a) and c) to f), GDPR. Further, the Buyer shall have the right to file an objection against the processing pursuant to Art. 21, GDPR and the right to data transferability pursuant to Art. 20, GDPR by sending an e-mail to the e-mail address info@100mega.cz.


8. The Buyer shall have the right to file an objection with the Office for Personal Data Protection if the Buyer thinks that his/her right to personal data protection has been violated.


9. The Buyer shall have no obligation to provide his/her personal data to the Seller. However, the provision of personal data is a necessary requirement for entering into and the performance of the contract; without the provision of the personal data necessary to perform the purchase order it is not possible to enter into the contract and/or to perform the contract by the Seller.


10. The personal data shall be processed automatically. There is no automated individual decision-making by the Seller in the sense of Art. 22, GDPR.


11. By completing the contact form, a visitor to the Seller’s website:


  • a) agrees to the use of the visitor’s personal data for the purposes of the electronic sending of commercial messages of the Seller and, at the same time;
  • b) declares that the visitor does not deem the sending of information pursuant to Point a) an unsolicited advertisement in the sense of Act No. 40/1995 Coll. as amended, as the user explicitly agrees to be sent the information pursuant to Point a) in combination with Section 7 of Act No. 480/2004 Coll;
  • c) consent pursuant to this paragraph may be withdrawn in writing by sending an e-mail to info@100mega.cz at any time.


 


12. The provider uses the so-called cookie files in order to improve the quality of services, personalisation of offers, collection of anonymous data and for analytical purposes in its presentation. Details on these cookies are specified in the cookie sidebar on the web interface. By using the website, the user agrees to the use of the above-mentioned technology.


13. The Buyer has been made acquainted with these Rules before the entering into the contract. By signing the contract of sale, the Buyer demonstrates that the Buyer has read these Rules and accepts them in their entire scope.


14. The Seller shall be entitled to amend these Rules. The Seller shall be obliged to publish a new version of the Rules, without undue delay, on its internet pages, or the Seller shall send the new version to the Buyer via the Buyer’s e-mail address. If the modification requires the consent of the data subject, the new version shall be presented for comments to see whether the data subject agrees or not. If the consent is not given, the personal data that is the subject of the consent will not be further processed and will be deleted.

16. The relationships not governed explicitly by these Rules shall be governed by the GDPR and the legal system of the Czech Republic, namely Act No. 89/2012 Coll., the Civil Code, as amended.


 


These Rules become effective on 25/05/2018.
